Who is Maros Kolpak?
Just as Jean-Marc Bosman changed the face of the football transfer system, so there are concerns that the European Court of Justice's Kolpak ruling will similarly affect rugby. Football has its Bosman ruling. Now sports like rugby are likely to remember the name of Maros Kolpak, the Slovakian handball player, in much the same way as footballers remember Jean-Marc Bosman.
What does a handball players have to do with rugby? Well, Koplak was a player in the German handball league, but was released by his club because of a set quota on non-EU players in the league, and he found himself surplus to requirements. So Kolpak took the matter to the European Court of Justice, just as Belgian Bosman did a decade ago, to challenge the concept of transfer fees on out-of-contract players.
The court found that, once a non-Eu national had obtained a work permit to ply his trade in a particular field in an EU country, he could not be restricted from doing so by arrangements such as quota systems. With time, the effects of this ruling will trickle through the game in Europe and some of the instances will be reported on below.
